VIP NATION VIP Package Release

PLEASE READ CAREFULLY PRIOR TO THE EVENING OF THE SHOW. YOU WILL BE REQUIRED TO SIGN THIS RELEASE ON THE EVENING OF THE SHOW IN ORDER TO RECEIVE YOUR VIP PACKAGE. YOU DO NOT NEED TO RETURN THIS RELEASE. THIS COPY IS FOR YOUR RECORDS ONLY.

As the purchaser of the VIP package you are entitled to receive all the items listed in the package description outlined on the purchase page and confirmation email you received.

VIP Nation and the tour do not guarantee any additional products or services with your purchase of a VIP Package. If circumstances beyond the control of VIP Nation prevent it from being able to provide the exact package stated above, a substitute of equal value will be provided. You agree to act in accordance with the rules articulated to you by VIP Nation and the tour prior to or during your participation in any activity related to the Package. You agree not to engage in any illegal or inappropriate activities, including, but not limited to, the use of illegal drugs or contraband (or alcohol if you are under the legal drinking age in the location of this show), engaging in acts that are considered disturbing to the tour or her staff, or the operations of a Package activity, the tour, or the venue in which a Package activity is taking place.  You agree not to wander off outside the Package activity area. VIP Nation and the tour reserve the right to remove you from a Package activity at any time for failure to abide by the terms of this Release or any other rules set forth at any time by the tour. In the event you are removed from a Package activity, VIP Nation and the tour shall not be obligated to refund any amounts paid by you for the Package.

In the event that the show for which you purchased a Package is cancelled, VIP Nation will provide you with a refund that represents the total amount paid to VIP Nation for the Package minus any non-refundable costs incurred by VIP Nation. Non-refundable costs may include, but are not limited to, costs associated with amounts paid to secure reservations that cannot be refunded, costs associated with personnel, and costs of previously purchased merchandise. In the event that the show for which you purchased a Package is postponed, VIP Nation in its sole discretion may either offer the Package during the rescheduled date or provide a refund representing the total amount of the Package minus any non-refundable costs incurred by VIP Nation. VIP Nation will not be responsible for the cancellation or postponement of a show for reasons beyond its control.

In consideration for your participation in the Package activities, you grant to VIP Nation the unrestricted, nonexclusive, royalty-free, irrevocable, worldwide, perpetual and fully sublicenseable right, in VIP Nation’s sole and absolute discretion, to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display your name, likeness, persona, appearance, picture, silhouette and/or any recording or other reproductions of your physical likeness, voice and/or sounds made by you (collectively, the “Image”), in any manner whatsoever as long as any such alteration does not diminish the integrity of the Image such that it no longer is an accurate representation of you, and to combine the Image with other images, text, graphics, photographs and artwork in connection with advertising, publicity, promotion, marketing and merchandising of any product or service of VIP Nation, its affiliates and partners, and the tour.  You hereby voluntarily relinquish any right that you may have to examine or approve the Image or any products or promotional materials that may be used in conjunction therewith. You hereby release and/or assign to VIP Nation all rights to the Image including without limitation moral rights and rights of publicity, and acknowledge and agree that all rights to the Image belong to VIP Nation irrevocably, free and clear of any obligation to you, and that you have no right to any consideration or accounting other than that as expressly agreed upon by you and VIP Nation. You agree you will have no right of equitable or legal relief.  To the maximum extent permitted by law, you agree that you will not sue VIP Nation, the tour or anyone else because the Image was not used or because you do not like the manner in which the Image was used.

You hereby release, discharge, indemnify and hold harmless VIP Nation, the tour, and Live Nation Entertainment, Inc., their respective parent, subsidiary and affiliated companies, and their respective officers, directors, shareholders, employees, agents, representatives, and assigns from any and all claims, causes of action, liabilities, costs and expenses (including reasonable attorneys’ fees) arising out of or related to your breach of this Release or your participation in any Package activity.

You hereby affirm that you are over the age of majority and have the right to contract in your own name. You have read the above and fully understand the contents thereof. This agreement shall be binding upon you and your heirs, legal representatives and assigns.
